When commissioning a fursuit from Tail Works, we execute a bilateral Service Agreement to protect both the artist and the buyer. Below is an English summary of the 12 key clauses of our standard agreement.
Key Contractual Clauses
Clause 1: Scope of Work
The contract covers design, digital 3D modeling, additive manufacturing (3D printing), and custom sewing/assembly of a fursuit character (or parts of it) based on the reference sheet approved at the time of commissioning.
Clause 2: Technology & Materials
Internal structures for the head and parts are 100% 3D-printed using flexible Thermoplastic Polyurethane (TPU) or foaming TPU. No traditional upholstery foam base is used. We use premium imported synthetic faux fur for the outer coat.
Clause 3: Financial Terms
Specifies the project scope tier (Head Only, Mini Partial, Full Partial, Fullsuit Digitígrade), calculated final adjusted price, and payment gateway fees. Shipping fees are not included and are calculated and billed separately after project completion.
Clause 4: Cancellation Terms
A mandatory 30% deposit is required to secure a production slot and is strictly non-refundable. If the client cancels later, progressive refunds of the remaining balance are calculated based on Trello progress logs. Projects completed beyond 90% receive no refund.
Clause 5: Anti-Fraud Protection
Unauthorized chargebacks or payment disputes result in immediate project termination, forfeiture of the item, and the client being blacklisted from our studio and shared artist protection networks.
Clause 6: Client Deliverables
The client must respond to WIP approval requests within 5 business days. For fullsuits, the client commits to submitting accurate body measurements and a Duct Tape Dummy (DTD) if/when necessary (or when requested by the studio).
Clause 7: Allergy Warning
Our studio operates in a residential setting containing domestic cats. The client acknowledges this warning and releases the studio from any liability regarding asthma attacks or allergic reactions.
Clause 8: Physical Liability
Fursuits restrict sensory inputs (vision/hearing) and trap heat. Performers assume all physical risks, including heatstroke, falls, or exhaustion, releasing the studio from liability.
Clause 9: Warranty & Maintenance
We offer a 90-day warranty against structural TPU base failure or stitching defects under normal use. The client pays for shipping to and from the studio. Modifications by third parties or improper washing void the warranty.
Clause 10: Intellectual Property
All digital models and 3D printed structural files remain the exclusive intellectual property of the studio. Molding, casting, or commercial replication is strictly prohibited. The client acquires physical ownership of the suit only.
Clause 11: Authentication & NFC
Completed suits include an embedded NFC authenticity microchip and QR code acting as a Certificate of Authenticity (COA). Reselling is allowed, but the new owner must notify the studio to update NFC ownership registration.
Clause 12: Governing Law
All transactions and contracts are governed by Brazilian law, electing the state of Rio Grande do Sul, Brazil as the legal jurisdiction. Fully recognizes the validity of electronic and digital signatures.
